DMCA Policy

1. DMCA Compliance

The Perez Code respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using our website or services. We reserve the right to remove content that is alleged to be infringing and to terminate the accounts of repeat infringers.

2. Designated Agent

Our designated agent for receiving DMCA takedown notices and counter-notifications is:

3. Filing a Takedown Notice

To file a DMCA takedown notice, you must provide a written communication that includes substantially the following:

  • Your physical or electronic signature (the copyrighted owner or authorized representative)
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing, with sufficient detail for us to locate it
  • Your contact information (address, telephone number, and email address)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

Send the written notice to our designated agent at the email above. Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing material and notify the user who posted it.

4. Counter-Notification

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may file a counter-notification. Your counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that was removed and where it appeared before removal
  • A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the federal district court in Delaware and that you will accept service of process from the person who filed the original notice

Send the counter-notification to our designated agent. If we receive a valid counter-notification, we will forward it to the original complaining party. If they do not file a court action within 10 business days, we may restore the removed material.

5. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We also reserve the right to remove content and terminate accounts of users who, in our sole discretion, are deemed to be infringing the intellectual property rights of others.
